What happens next: Your answers help [Firm Name] prepare your Florida living will. This form doesn't create the document. Florida law calls for a living will to be signed in front of two witnesses, and at least one of them can't be your spouse or a blood relative. We'll go over your answers with you and arrange the signing.

Clients often want to talk through their end-of-life wishes long before they’re ready to sign anything. The Florida Living Will Intake Form Template gives elder-law and estate planning firms a way to collect those instructions online, so you can prepare the living will before the signing appointment.

The form records a client’s wishes. It doesn’t create a living will on its own. Florida has its own signing and witness rules, so have your wording and process reviewed against current Florida law before you publish.

Understanding the Florida Living Will

A living will, also called an advance directive, records a person’s choices about life-prolonging treatment for a time when they can’t speak for themselves. Florida’s suggested living will form also includes a place to name a health care surrogate.

Under section 765.302 of the Florida Statutes, the person signs the living will in front of two witnesses, and at least one of them can’t be their spouse or a blood relative. This template doesn’t collect witness details. It gathers the instructions so you can prepare the document for signing.

Using the Florida Living Will Intake Form Template

The Declarant Information section collects the client’s full legal name, date of birth, phone, email, and address. The address fields are set up for US addresses.

Your Health Care Surrogate asks for the surrogate’s name, phone, email, address, and relationship to the client.

Your Instructions starts by asking which conditions the instructions should cover: a terminal condition, an end-stage condition, or a persistent vegetative state. For life-prolonging procedures and for artificial nutrition and hydration, the client chooses to withhold or withdraw, to provide, or to discuss it with you first.

Pain relief and organ and tissue donation work the same way, and donation is optional. An Additional Instructions box covers anything else.

Review and Sign shows a short note in your firm’s words, then a confirmation checkbox, the client’s signature, and the date.

You’ll get an email notification for each submission, and the client gets a short confirmation. Use it as a Florida advance directive questionnaire or an end-of-life wishes intake form. Add the PDF addon if you’d like a copy for the client file.
